The petitioner alleges non-compliance of the order for inclusion in voter list passed in CWJC No.4404 of 2016. Mr. Amit Shrivastava, learned counsel appearing for the State Election Commission and counsel for the State inform this Court that neither the petitioner's name figured in the Assembly voter-list of 2015 nor did she file the prescribed form 'M-' for inclusion of her name in the Panchayat voter-list and although she did take steps for inclusion of her name in the Assembly voter-list which was included in the year 2016 but the act by itself would not result inclusion of name of the petitioner in the Panchayat voter list and for which she had to
Patna High Court MJC No.1261 of 2016 (2) dt.12-04-2016 file the prescribed form 'M-'. It is stated at the Bar that these relevant facts were not brought to the notice of this Court when the order was passed on the writ petition.
Considering the circumstances and on instruction received Mr. Mritunjay Prasad Singh, learned counsel appearing for the petitioner admits to the position and prays for withdrawal of the contempt application which is accordingly dismissed as withdrawn.
