JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 457, 392 of the Indian Penal Code.

The name of petitioner came in this case in confessional statement of co-accused, Akash Bharti, who has already been granted privilege of bail by this court vide order dated 10.03.2016 passed in Cr. Misc. No. 11047 of 2016. It appears from perusal of the impugned order that learned Sessions Judge rejected the prayer for bail of the petitioner as the Test Identification Parade of the petitioner has to be done but it is well known fact that no person can be detained in custody for holding

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 588 of 2015.
