2. The petitioner is in judicial custody in connection with Bettiah Mufassil P.S. Case No. 566 of 2020 registered under sections 302, 201 as well as 120(B) of the Indian Penal Code.

3. On 20.5.2022, the bail application was rejected on merit by a reasoned order. This is second attempt.

4. On 6.10.2023, a report was called for from the Trial Court and as per the letter no. 839 dated 12.10.2023 sent by the learned Additional District and Sessions Judge, 5th Bettiah, West Champaran, three out of six prosecution witnesses have been examined.

5. Taking into account the aforesaid fact, the Trial Court is directed to expedite the trial and conclude the same within a period of nine months from today in view of the fact that the petitioner is in custody for three years (1.9.2020).

6. The Superintendent of Police, Bettiah, West Champaran shall ensure that the witnesses summoned by the Trial Court remain present on the date fixed by the Trial Court.

8. The bail application is rejected with the aforesaid observation.
