JUSTICE DINESH KUMAR SINGH ORAL ORDER 05-04-2016 Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A, 341, 323, 504, 506, 34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. The accusation is of torture for non-fulfillment of the dowry demand.

On instruction, learned counsel for the petitioner submits that the petitioner admits his marriage with the informant but earlier the informant also lodged Buxar (Town) P.S. Case No.462/2014 levelling accusation under sections 341/323/498A/501/506/34 IPC read with 3/4 of the Dowry Prohibition Act, wherein the petitioner has been acquitted by learned SDJM, Buxar vide judgment dated 01.08.2015 and,

Patna High Court Cr.Misc. No.15043 of 2016 (2) dt.05-04-2016 2/2 immediately, thereafter, the present case has been lodged on 24.09.2015.

Considering the fact that in the earlier case, lodged by the informant, the petitioner has been acquitted and immediately thereafter the present case has been lodged, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Buxar in connection with Buxar(Mahila) P.S. Case No.32/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
