03-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Barhara P.S. Case No. 205 of 2020, registered for the offence under Sections 341, 323, 324, 307, 325, 379, 302, 504, 506/34 of the Indian Penal Code. As per the prosecution case, all the FIR named accused persons armed with lathi, danda and iron rod, dragged father of informant from his door and assaulted him with iron rod on his head, due to which, in course of treatment, he died and when the informant went to save his father, he was abused and assaulted by accused persons. The accused persons also snatched Rs. 40,000/- from pocket of the informant. It is submitted on behalf of petitioner that there is case and counter case and both sides sustained injury. It is further submitted that due to land dispute between the parties, the alleged occurrence took place. There is general and omnibus

Patna High Court CR. MISC. No.44665 of 2021(2) dt.03-11-2021 2/2 allegation and no specific allegation has been attributed against this petitioner. Petitioner is an old-aged person, having no criminal antecedent, and he is in custody since 21.03.2021. Chargesheet has already been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Purnea in connection with Barhara P.S.
