2. This is the second attempt of the bail of the petitioner. Earlier, the prayer for bail was rejected by this Court vide order dated 20.11.2024 passed in Cr. Miscellaneous No. 60552 of 2024.

3. The petitioner seeks bail in connection with NDPS Case No. 30 of 2024(S), arising out of Ratanpura P.S. Case No. 27 of 2024 registered for the offence under Section 8/20(b)(ii) (c)/29 of the NDPS Act.

4. As per the prosecution case, there is recovery of 21 kg of Ganja from three unknown persons and the petitioner is one of them. Two persons fled away from the place of occurrence and the petitioner was caught red handed on the spot. He was carrying 7 Kg. of ganja.

5. Learned counsel for the petitioner submits that petitioner is innocent and falsely been implicated in this case. Petitioner has got one criminal antecedent and he is in jail since 02.04.2024. Similarly situated co-accused person namely Dhalai Yadav @ Narendra Yadav has already been granted regular bail by this Court vide order dated 21.02.2025 passed in Cr. Miscellaneous No. 6586 of 2025. Learned counsel further submits that in the trial only one witness has been examined till date.

6. Considering the allegation, period of custody, delay in trial and similarly co-accused person has already been granted bail, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Session Judge-IV, Supaul/concerned Court below in connection with NDPS Case No. 37/2024, arising out of Ratanpura P.S. Case No. 27 of 2024.

8. As a condition of this order, the petitioner after being released on bail is directed to mark his attendance at Ratanpura Police Station on every Sunday of each month. Any default in appearance at the police station will result in

9. As a condition of this order, the petitioner, after being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

10. At the time of furnishing the bail bonds, the petitioner is directed to file an affidavit that he will not involve himself anymore in a case of similar nature. If the petitioner is found to be involved in a case of similar nature, his bail bonds shall be cancelled by the Court below forthwith. (Sandeep Kumar, J) Ranjeet/- U T
