Petitioner happens to be husband of the deceased whose dead body was found near Ganga river and one injury was also found on the person of the deceased.
Therefore, considering the facts and circumstances as well as nature of the allegation levelled against the petitioner, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Sessions Trial no. 643/2014 arising out of Akbarnagar P. S. case no. 82/2013 pending in the court of the 3rd Addl. Sessions Judge, Bhagalpur stands rejected. However, the learned trial court is directed to expedite the trial of the petitioner and conclude the same as early as possible preferably, within nine months from the date of receipt/production of a copy of this order.
Patna High Court Cr.Misc. No.21647 of 2015 (2) dt.06-07-2015 It is made clear that if trial of the petitioner is not concluded within the above stated period, he may renew his prayer for bail before the trial court itself.
