JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02/ 07.07.2015 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State.

Petitioners are in jail custody since 6.4.2015 in a case registered under section 307 and other allied sections of the Indian Penal Code.

According to the prosecution case itself, informant and two injured of this case were, initially, assaulted by co-accused Jitendra Kumar Yadav, Arbind Kumar and Rajendra Singh and after that when all the injured fell down, petitioners are said to have assaulted injured persons by means of lathi. One injured Rinku Kumari has sustained grievous injury on her head whereas two injured has sustained simple injury.

So far as injury found on the head of Rinku Kumari is concerned, it has, specifically, been mentioned in the first information

Patna High Court Cr.Misc. No.22592 of 2015 (2) dt.07-07-2015 report that co-accused Jitendra Kumar Yadav, Arbind Kumar and Rajendra Singh caused injuries on the heads of all injured persons of this case.

Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri Birjesh Mani Tripathi, Judicial Magistrate, Ist Class, Jehanabad/concerned court in Kaler P.S. Case no. 36/2014.
