Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 342, 376/34 of the Indian Penal Code.

There is allegation of gang rape against the petitioner and one co-accused, Birendra Kumar Rai but co-accused, Birendra Kumar Rai has already been granted privilege of bail by this court vide order dated 16.03.2016 passed in Cr. Misc. No. 11745 of 2016 taking note of this fact that near about after four months of the alleged occurrence, the complaint case was filed which was

Patna High Court Cr.Misc. No.14391 of 2016 (2) dt.07-04-2016 2/2 converted into police case.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No. 155 of 2010.
