JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report rather in the first information report, it has specifically been averred that F.I.R named accused committed murder of the deceased. The informant claimed himself to be an eye witness of the alleged occurrence. The name of petitioner appears to have come in this case on the statements made in paras- 74 and 78 of the case diary. The learned Session Judge has not disclosed the materials which have come in the aforesaid paras-74 and 78 of the case diary and he only stated that the aforesaid paragraphs reflect the involvement of the petitioner in the alleged crime. Moreover, it appears that the F.I.R named accused have already been acquitted.

No.14569 of 2016 (2) dt.08-04-2016 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Begusarai Town P.S.Case No. 112 of 2014.
