JUSTICE PURNENDU SINGH ORAL ORDER 17-04-2025 Heard Mr. Sashi Bhushan Singh, learned counsel appearing on behalf of the petitioner; Mr. Gyan Shankar, learned counsel for the Bihar Staff Selection Commission and Mrs. Binita Singh, learned SC-28 for the State.

2. Learned counsel appearing on behalf of the petitioner submitted that pursuant to the Advertisement No. 210/2010, the petitioner had applied under Backward Category

Patna High Court CWJC No.10176 of 2020(6) dt.17-04-2025 2/2 for appointment to the post of Assistant Primary Teacher, but his name figured under General Category in the list so prepared by the Bihar Staff Selection Commission, which is not in accordance with law.

3. A counter affidavit has been filed on behalf of the respondents no. 5 to 7.

4. In view of the admission made in paragraph nos. 8 and 9 of the counter affidavit, I find that the grievance of the petitioner is required to be redressed as and when the turn of the petitioner comes but before that, objection of the petitioner, if any, filed before the Commission in respect of the claim that he comes under Backward Category, is required to be disposed of in accordance with law.

5. Accordingly, the present writ petition stands disposed of.
