The petitioner has put to challenge an order passed by the Sub Divisional Officer, Pupri-cum-Licencing Authority, whereby the petitioner's licence to run a P.D.S. shop has been cancelled.
The petitioner has remedy of preferring appeal against the said order before the appellate authority, which he has not availed.
Considering the facts and circumstances and prevailing COVID-19 pandemic situation, it is considered
Patna High Court CWJC No.8625 of 2020(2) dt.06-04-2021 2/2 proper to dispose of the writ application with a liberty to the petitioner to approach the appellate authority against the said order by filing appeal. If he does so within one month from today, the appellate authority shall liberally consider the petitioner's prayer for condonation of delay in filing the appeal and pass his orders on merits within six months thereafter. This application stands disposed of with aforesaid observations.
