1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Raniganj P.S. Case no.450 of 2023 registered under section 392 of the Indian Penal Code.

3. As per the prosecution case, while the informant was coming on his motorcycle, three accused persons on a motorcycle dashed the vehicle of the informant and looted the informant of Rs.1.91 lacs in cash besides his mobile phone etc. as mentioned in the F.I.R.

4. Learned counsel for the petitioner submits that the F.I.R. was registered against three unknown accused persons. Referring to the order of the learned trial Court, it is submitted that the name of the petitioner transpired in the confessional

Patna High Court CR. MISC. No.39496 of 2024(2) dt.03-06-2024 2/2 statement of a co-accused Laltu Kumar Sharma made before police. No incriminating article has been recovered from the petitioner's possession nor has he been put on T.I. parade inspite of being in custody since 29.1.2024. Chargesheet has been submitted in the case. The cause of false implication of the petitioner is his antecedents.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and having perused the material on record, the allegations in the F.I.R. and the contents of the order of the learned trial Court, no incriminating article having been recovered from the petitioner's possession, his being in custody since 29.1.2024 and not having been put on T.I. parade, the Court directs the petitioner to be enlarged on bail in connection with Raniganj P.S. Case no.450 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Araria.
