JUSTICE SUDHIR SINGH ORAL ORDER 23-05-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 420 and 406 of the Indian Penal Code. Allegation against the petitioner is that he has misappropriated public money.

It has been submitted on behalf of the petitioner that he is in custody since 12.3.2016. B.S.F.C. has already filed a Certificate Case bearing no. 30Y/2013-14. Petitioner has already remained in custody for substantive period.

On behalf of the State and the O.P. no. 2, it is submitted that petitioner is named in the F.I.R. and public money is said to have been misappropriated by him. The Certificate Case pending against the petitioner has not been denied by the learned counsel for the B.S.F.C.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.16732 of 2016 (3) dt.23-05-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabhua, in connection with Mohania P.S. Case no. 301 of 2013.
