The petitioner seeks bail in Bhabua (Sonhan) P.S. Case No. 122 of 2021, registered for the offence punishable under Section 498(A) and other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner along with family members committed torture and cruelty with informant for non-fulfillment of demand of dowry. It is further alleged that on 08.03.2021 petitioner demanded Rs. 50,000/- as dowry and due to non-fulfillment of the same she was badly assaulted by the petitioner and when her mother and maternal grandfather (Nana) came to rescue, they were also assaulted by the petitioner and others with lathi and danda causing fracture in

It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. There is case and counter case. Counter case has been filed with allegation that while there was hot exchange between petitioner and informant, suddenly mother and maternal grand father (Nana) of informant came there to pacify the matter in that process informant party started assaulting the petitioner causing injury on his head thereafter Bhabua (Sonhan) PS Case No. 123 of 2021 has been lodged. It is further submitted that petitioner is still ready to keep the informant and his child with full honour and dignity. Petitioner is in custody since 10.03.2021. Chargesheet has already been submitted.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabua, Kaimur in connection with Bhabua (Sonhan) P.S. Case No. 122 of 2021.
