The petitioner seeks bail in a case registered for the offences punishable under sections 394/34 of the Indian Penal Code and section 27 of the Arms Act.
The petitioner is not named in the F.I.R. Binod Yadav in paragraph 17 and Pavitra Yadav in paragraph 18 of the case diary disclosed that the petitioner and one another person was moving on Pulsar motor cycle but those witnesses did not inform the informant or the police immediately after the occurrence. The petitioner was arrested on 04.03.2015 but till date he has not been put on T.I. parade although the informant claimed to identify the accused.
Considering the facts aforesaid, the petitioner
Patna High Court Cr.Misc. No.21935 of 2015 (3) dt.08-09-2015 above named is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Bihra P.S. Case No. 06 of 2015, G.R. No. 52 of 2015.
