JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Section-394 of the Indian Penal Code.

One FIR named accused namely, Babloo @ Balli Faruki was caught by the police just after the occurrence of dacoity. The aforesaid co-accused Babloo @ Balli Faruki disclosed the name of petitioners, in presence of police as well as other witnesses and, after that, petitioners were arrested and remanded in this case on 20-02-2016.

Learned counsel for the petitioners submits that

Patna High Court Cr.Misc. No.14594 of 2016 (2) dt.08-04-2016 2/2 except the so-called confessional statement of co-accused, there is nothing against the petitioners, who do not have any criminal antecedent and uptill now, they have not been put on test identification parade.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Dehri (T) P.S. Case No. 32 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Dehri, Distt. Rohtas.
