Heard learned counsel for the petitioner and the learned A.P.P. for the State through Video Conferencing. The petitioner apprehends his arrest in connection with Kartahan C2A Case No. 133 of 2019, registered under Section 30(a) of the Bihar Excise Act.
The accusation is that on receiving secret information about keeping of illicit liquor by Vijay Singh (petitioner) in village Ghataro Chatarbhuj, the informant along with other excise officials reached there. On search, 128 bottles
Patna High Court CR. MISC. No.35732 of 2020(2) dt.04-05-2021 2/2 each containing 180 ml of Indian made foreign liquor were recovered from the back of the house of the petitioner concealing in the paddy straw.
Learned counsel for the petitioner submits that petitioner was not apprehended at the spot rather the alleged 128 bottles each containing 180 ml of Indian made foreign liquor are said to be recovered from the back of the house of the petitioner. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II-cum-Excise Court, Hajipur, Vaishali in connection with C2A Case No. 133 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
