JUSTICE RAJIV ROY ORAL ORDER 07-07-2023 A mother kept her child in womb for nine months so that he could see the light of the world little realizing that he will turn out to be the person responsible for her leaving the world.

This is what has been alleged in the F.I.R. against the petitioner. He abused and assaulted his mother (the informant) who breathed her last in the hospital.

Heard Mr. Binod Kumar, learned counsel for the petitioner and Mr. Jitendra Kumar Singh, learned APP. The petitioner is in judicial custody in connection with Sessions Trial No. 682 of 2022 arising out of Chakmehsi

Patna High Court CR. MISC. No.37663 of 2023(2) dt.07-07-2023 2/2 P.S. Case No. 74 of 2022 (G.R. No. 1138/2022) for the offence registered under Sections 341, 323, 324, 307, 504 and 379 of the Indian Penal Code and later on section 302 of the Indian Penal Code was added lodged by Kalawati Devi (deceased) on 06.05.2022.

In view of the facts that a son has killed his mother and the deceased lady herself is the informant, the bail application of the petitioner stands dismissed. The Trial Court is directed to expedite the trial and conclude the same at an earliest.
