JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 Heard learned counsel for the petitioner and learned APP appearing for the State The petitioner is in custody in a case registered under Sections 363 and 366 of the Indian Penal Code. The prosecution case, in brief, is that the daughter of the informant namely, Sarita Devi, who went to Sitakund Dham Mela on 03.10.2014 has not returned home till evening and on being searched she could not be found. On 04.10.2014 in the night at 1.10 A.M. the informant received a call asking him to come to come to Patna where is daughter is kept. The informant has suspected that the holder of the mobile phone from which he received the call has kidnapped his daughter and hence, he filed an application before the Officer-in-charge, Pipra Police Station.

Patna High Court Cr.Misc. No.22189 of 2015 (2) dt.21-07-2015 It is submitted on behalf of the petitioner that the petitioner is in custody since 05.01.2015. Charge sheet has already been submitted in this case. In the case by way of supplementary affidavit the statement of the victim recorded under Section 164 Cr.P.C., has been brought on record. From perusal of the same it appears that the victim had gone with the petitioner at her own will.

On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Pipra P.S. Case No. 231 of 2014. (Sudhir Singh, J) Chandran U T
