JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 13-04-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner wants to renew his prayer for bail which was earlier rejected by order dated 03.10.2015 passed in Cr. Misc. No. 26830 of 2015 on the ground that the petitioner is suffering in custody since 10.03.2015 and up till now there is no progress in the case resulting in near future the trial is not likely to be concluded.

The learned A.P.P. opposes prayer for bail by submitting that against the petitioner there is allegation that he assaulted by the lathi repeatedly causing injuries to Arun, Monu and Amarnath and during treatment Arun died.

In the facts and circumstances as stated above, finding no good ground for reconsideration of prayer for bail, again prayer

Patna High Court Cr.Misc. No.15955 of 2016 (2) dt.13-04-2016 2/2 for bail of the petitioner stands rejected in connection with Buxar (T) P.S. Case No. 109 of 2015 pending in the court of the learned Chief Judicial Magistrate, Buxar.

However, considering detention of the petitioner, let the trial be expedited and concluded within six months, failing which the petitioner may be at liberty to renew his prayer for bail, if at no fault.
