JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 13-08-2024 Having gone through the case in its entirety and heard both sides, it is deemed fit, proper and in the interest of justice, to relegate the case of the petitioner before the concerned authority for just and proper decision.

Accordingly, I direct the petitioner to file a detailed representation before the Director, Secondary Education, Education Department, Government of Bihar, Patna (respondent no.3) along with all supporting documents and the judgment of the Hon'ble Apex Court as cited by the petitioner in support of his claim within a period of two weeks from today. The Director, Secondary Education, Education Department, Government of Bihar, Patna (respondent no.3) is directed to

Patna High Court CWJC No.1526 of 2021(8) dt.13-08-2024 2/2 consider the case of the petitioner after affording opportunity of personal hearing and pass a reasoned and speaking order in the light of the judgment dated 23.11.2012 passed in Civil Appeal Nos.8226-8227 of 2012 in accordance with law within eight weeks from the date of receipt of such representation.

3. It is made clear that the Director, Secondary Education, Education Department, Government of Bihar, Patna (respondent no.3) shall be solely liable for non-compliance of this order within the stipulated period.
