Petitioner seeks bail in a case registered under section 414/34 of the Indian Penal Code.

According to the prosecution case itself, seized motorcycle was being driven by co- accused Md. Nasir who was caught along with seized motorcycle. So far as the petitioner is concerned, his name was disclosed by co- accused Md. Nasir.

Moreover, co-accused Md. Nasir has already been granted privilege of bail by a coordinate bench of this court. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in Katihar Town P.S.
