JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-04-2016 Heard learned counsel for the petitioner and the State. The petitioner is an accused in Kinger P.S.Case No. 40 of 2015 registered under Sections 304(B) and 201/34 of the Indian Penal Code.

Accusation is that the sister of the informant was murdered by the petitioner and other accused persons due to non fulfillment of demand of dowry and disposed of her dead body. Learned counsel appearing on behalf of the petitioner submits that the petitioner happens to be the husband of the deceased. He further submits that she died due to abdomen pain on 22.4.2015 and thereafter on information the informant also participated in cremation but due to ulterior motive and misconception the informant lodged the present case. No.17674 of 2016 (2) dt.28-04-2016 2/2 submits that after realizing the mistake, the informant has filed a petition in the court of learned C.J.M., Jehanabad on 12.05.2015 to the effect that the present case has been lodged by him on misconception. He further submits that the petitioner is in custody since 09.12.2015. The petitioner has one baby, aged more than one year and she is being taken care of by the family members of the petitioner.

Having regard to the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Jehanabad in Kinger P.S.Case No. 40 of 2015.
