JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 447, 325, 307, 379/34 of the Indian Penal Code. As per allegation in the F.I.R, some co-accused including the petitioners surrounded with lathi, iron rod and pistol to the house of the informant. The petitioner has pointed out pistol upon the neck of the informant and other co-accused persons have been assaulted the informant's father, mother. Learned counsel for the petitioner submits that petitioner has falsely implicated in this case. Petitioner is not assaulted to anyone. The allegation against the petitioner is that he has pointed out the pistol to the neck of the informant. On

Patna High Court CR. MISC. No.43777 of 2021(2) dt.23-03-2022 2/2 similar footing co-accused have been granted bail in Cr. Misc. No. 24277 of 2021 vide order dated 18.01.2022. Learned Additional Public Prosecutor opposed the bail prayer of the petitioners and submitted that he has one criminal antecedent which is mentioned in Para-3 of the petition.

Considering the facts and circumstance of the case as well as submission of the parties, let the above named petitioner, in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S.Case No. 625 of 2020 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
