Petitioner is in jail custody since 12.02.2016 in a case initially, registered for the offences punishable under Section 326 and other minor sections of the Indian Penal Code but subsequently, police after investigation, found the case true under Section 307 of the Indian Penal Code.
In the present case, informant as well as his wife are said to have sustained injury. The informant appears to have sustained simple injury and so far as informant's wife is concerned, her tooth was found broken as a result of which doctor opined that injury was grievous in nature. Moreover, there is
Patna High Court Cr.Misc. No.16341 of 2016 (2) dt.26-04-2016 2/2 counter case also and it is alleged that petitioner as well as his other family members, too, sustained injury.
Petitioner and informant are full brothers and submission on behalf of the petitioner is that the alleged occurrence took place on account of land dispute. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saran at Chapra in connection with Khaira (Nagra) P.S. Case No. 141 of 2015.
