JUSTICE MOHIT KUMAR SHAH ORAL ORDER 25-09-2024 The present writ petition has been filed seeking the following reliefs:- "I. That the present writ application had been preferred for issuance of an appropriate writ order or direction in the nature of mandamus to command and direct the
3/4 District Magistrate, Nalanda, and the Superintendent of Police, Nalanda to protect the property of the petitioner from the illegal encroachment and the peaceful possession of the land described in Para- 11 of the present writ application from the encroachers on the ground that land belongs to the petitioner, who is having right, title and possession of the land and no unauthorized or illegal encroachment or illegal interference is permissible to distract and hamper the peaceful possession of the petitioner.
11. That the present writ application has been preferred for issuance of an appropriate writ order(s) or direction(s) in the nature of Mandamus to direct the Respondent authority to remove encroachment from the land as described in Para-11 to the writ application on the ground that the scheduled land is Raiyat Khatiyani land of the petitioner and the Opposite-2nd party has encroached over the said land of the petitioner in an illegal manner.
III. That the present writ application has been preferred for issuance of an appropriate writ order(s) or direction(s) in the nature of Mandamus to command and direct the respondent authority to consider the representation preferred on behalf of the petitioner in accordance with law."

After some arguments, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other
4/4 alternative remedies as are otherwise available under the law. Liberty, so sought, is granted.

The writ petition stands disposed off.
