The petitioner has preferred this application for grant of regular bail in a case registered under sections 25(1-B)(a), 26 and 35 of the Arms Act.

As per the prosecution case, a loaded country made pistol with a live cartridge as also 15 other live cartridges were recovered from the possession of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. The petitioner is in custody since 12.3.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal

No.44107 of 2021(2) dt.24-01-2022 2/2 antecedent and having remained in custody for over 10 months, the Court directs the petitioner to be enlarged on bail in connection with Beldaur P.S. Case no. 48 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Khagaria.
