Earlier the petitioner has approached this Court in C.W.J.C. No. 8074 of 2011 which was disposed of, on 04.10.2012, with a direction to the Special Director, Secondary Education to examine the claim of the petitioner and pass a reasoned order.
The present application is filed by the petitioners aggrieved by the order dated 09.02.2015 passed by the respondent 2 whereby the respondent 3 has been directed to ensure the payment of salary. It appears that the issue with regard to the approval of service of the petitioners is still pending at the level of Sanskrit Shiksha Board and unless the
Patna High Court CWJC No.16563 of 2017(3) dt.08-07-2019 2/2 approval is granted, petitioner cannot be granted the appropriate remedy in the instant case.
Considering the aforesaid, the Court directs the Bihar Sanskrit Shiksha Board to take appropriate decision with regard to the approval of service of the petitioner at the earliest, preferably within a period of three months from the date of receipt/production of a copy of this order.
After the decision of the Sanskrit Shiksha Board, the petitioner shall be eligible for grant of payment of salary with arrears. The District Education Officer would be under obligation to ensure the payment of the arrears to the petitioners after approval of their service by Sanskrit Shiksha Board. Necessary decision in this regard shall be taken by the Sanskrit Shiksha Board and follow up by the District Education Officer within the time frame indicated hereinabove.
With the aforesaid, the present writ application stands disposed of.
