Petitioner seeks bail in a case registered under section 307 and other allied section of the Indian Penal Code. The prosecution case in short is that one Maksud Alam Asrafi, Officer-incharge of Bihara P.S. written himself statement on 29.05.2012 alleging that when he has arrested the petitioner in Bihara P.S. Case no. 81 of 2011 registered under section 302 and minor sections of I.P.C. and Bihara P.S. Case no. 45 of 2012, registered under sections 420, 182, 173, 466, 468, 120(B) of the Indian Penal Code their supporters have obstructed and also committed Marpait with the police party.

Patna High Court Cr.Misc. No.22087 of 2015 (2) dt.16-07-2015 2/2 It has been submitted on behalf of the p[etitioner that there is general and omnibus allegation against the petitioner. Further it has been submitted that other co-accused has been granted anticipatory bail vide Cri. Misc. No. 51107 of 2012 and Cri. Misc. No. 35353 of 2013.

On behalf of the State it has been submitted that petitioner is named in the F.I.R.

Considering the facts that the other accused persons have been granted anticipatory bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thouand0 with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in Bihra P.S. Case no. 68 of 2012.
