The petitioner seeks bail in connection with Sessions Trial No. 35 of 2023 arising out of Kasim Bazar P.S. Case No. 259 of 2022 registered for the offence under Sections 25(1-A), 25(1-AA), 25(1-B)A, 26(i)(ii) and 35 of the Arms Act. As per the prosecution case, the allegation against the petitioner is that the petitioner was running mini gun factory in his house and on search five pieces of partly made magazine, two pieces of partly manufactured pistol, five cartridges and some instruments and tools were also recovered.
Patna High Court CR. MISC. No.35072 of 2023(2) dt.12-07-2023 2/2 Learned counsel for the petitioner submits that the petitioner is in custody since 22.09.2022 and nothing has been recovered from the conscious possession of the petitioner. Learned A.P.P. has vehemently opposed the prayer for bail.
The petitioner belongs to Munger and is involved in manufacturing of illegal arms including Carbine. Considering the allegation levelled against the petitioner, I am not inclined to grant bail to the petitioner. This application for regular bail stands rejected. The Court below is directed to expedite the trial of the petitioner.
If there is no sufficient progress in the trial for a year then the petitioner may renew his prayer for bail. (Sandeep Kumar, J) Shishir/- U T
