JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case initially, registered for the offences punishable under Sections 341, 307, 498A/34 of the Indian Penal Code and Section 3⁄4 of D.P. Act and later on, Section 304B of the Indian Penal Code was also added. Petitioner happens to be husband of the deceased, who made statement before her death and in the aforesaid statement, she specifically stated that it was petitioner, who lit fire on her body.
The aforesaid statement of deceased amounts to her dying declaration and, therefore, I am not inclined to release the
Patna High Court Cr.Misc. No.15760 of 2016 (2) dt.20-04-2016 2/2 petitioner on bail. Hence, his prayer for bail in connection with Sessions Trial No. 384 of 2015 arising out of Kotwali P.S. Case No. 751 of 2014 pending in the court of learned Sessions Judge, Bhagalpur stands rejected.
