The petitioner seeks bail in Complaint Case No. 1689 of 2009, instituted for offence under Section(s) 498(A) of the Indian Penal Code.

Learned counsel for the petitioner has submitted that petitioner is husband of informant.

It is alleged in the complaint petition that complainant/O.P. No. 2 was married with this petitioner in the year 1999. After marriage complainant was tortured in her Sasural for demand of Rajdoot Motorcycle. It is alleged that complainant was ousted from her matrimonial house.

No.32369 of 2019(2) dt.15-05-2019 2/2 Learned counsel for the petitioner has submitted that complainant has performed her second marriage with one Masudan Paswan @ Maksudan Paswan, s/o Visheshwar Paswan of Vill.- Harpur Bhindi, P.O.- Harpur Bhindi, P.S.- Tajpur, Samastipur, which would be apparent from perusal of Aadhar Card, Voter Card of the complainant as well as certificate issued by Mukhiya of Raj Harpur Bhindi Panchayat dated 15.04.2019. Aforesaid documents are annexed as Annexure-3 series. Petitioner is in custody since 29.03.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XIIth, Vaishali at Hajipur, in connection with Complaint Case No. 1689 of 2009, subject to the conditions that both the bailors shall be the close relative of the petitioner.
