The petitioner Kusum Tikmani seeks bail in a case under Sections 304B/34 of the Indian Penal Code. The father of the deceased made allegation that his daughter was married to Ashish Tikmani, son of the petitioner, five years ago. The husband, father-in-law and mother-in-law were torturing the deceased due to non-fulfillment of demand of dowry. He received a call on 12.06.2010 from Vijay Tikmani that his daughter committed suicide. The informant alleged that the accused persons including the petitioner killed his daughter. It is submitted that the petitioner is the mother-in-law of the deceased. There is no evidence to show that the petitioner ever tortured his daughter-in-law. The deceased committed suicide. Patna High Court Cr.Misc. No.6898 of 2015 (6) dt.05-05-2015 2/2 never made any complain to any of his colleagues although she was a lawyer of this Court.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the fact that the petitioner is the mother-in-law of the deceased and she is in jail since 04.01.2015, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Patna in Kadamkuan P.S. Case No. 193 of 2010.
