JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-11-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 498A and other ancillary sections of the Indian Penal Code and under sections 3⁄4 of the Dowry Prohibition Act .

As per the prosecution case, this petitioner and her family members tortured and assaulted the victim for non fulfilment of demand of dowry.

Learned counsel for the petitioner submits that the petitioner is mother in law and she is innocent and has falsely been implicated in this case. There is general and omnibus

Patna High Court CR. MISC. No.45781 of 2021(2) dt.16-11-2021 2/2 allegation of assault and torture against all the accused persons and no specific overt has been alleged against the petitioner. She is in custody since 25.3.2021. Charge sheet has already been submitted.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Bhagalpur in Bhagalpur Mahila Police Station Case No. 5 of 2019/GR No.123 of 2019.
