JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 41(1), 41(2) of Bihar Prohibition and Excise Act, 2016.

In huge quantity Indian made foreign liquor was recovered from an abandon bolero vehicle. However, in course of investigation, co-accused, Abhishek Kumar and Kamlesh Rai were arrested and both the aforesaid apprehended accused disclosed that they had purchased the recovered liquor from the petitioner. It appears that except the aforesaid material as well as some criminal antecedent of the petitioner, there is nothing against him.

Case No. 417 of 2018.
