The petitioner is accused in connection with Buxar(M) P.S. Case No. 41 of 2015 registered under Sections 414 of the Indian Penal Code and Section 25(1-b)a and 26 of the Arms Act. The accusation is that petitioner was apprehended with one country made pistol, one live cartridge and one motorcycle without valid paper by the police.
Learned counsel for the petitioner submits that the alleged recovered arms were not belonging to the petitioner rather due to enmity villagers handed over the petitioner with the said arms to the police. It is further submitted that petitioner is accused
Patna High Court Cr.Misc. No.23232 of 2015 (3) dt.01-10-2015 in one another case, in which, he is on bail and in the present case he is in custody since 17.02.2015.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Buxar, in connection with Buxar (M) P.S. Case No. 41 of 2015. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
