JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-B)a, 26, 35 of the Arms Act.

One country made loaded pistol and eleven live cartridges are said to have been recovered beneath the bed of the petitioner.

Contention on behalf of the petitioner is that the aforesaid recovery is said to have been made from Basa of the petitioner but the said recovery was made in absence of the petitioner and moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 26.10.2015.
