1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Muffasil P.S. Case no.138 of 2025 registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. As per the prosecution case, 10 litres of country liquor was recovered from the hut of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner who has no criminal antecedent and is in custody since 13.3.2025 has been falsely implicated in the case. He undertakes to cooperate in the investigation/trial.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the FIR, his being in custody since 13.3.2025, chargesheet having been submitted in the case and specially the petitioner not having any antecedent under the Bihar Prohibition and Excise Act, 2016, the Court directs the petitioner to be enlarged on bail in connection with Muffasil P.S. Case no.138 of 2025 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court no.1, East Champaran, Motihari.
