The petitioner is in custody in connection with Panapur P.S.Case No. 124/2014 for the offences under Sections 341, 323, 376 and 504 of the Indian Penal Code and Section 3 / 4 of D.P. Act.

The allegation against the petitioner is of committing rape upon the informant as well as demand of dowry. On behalf of the petitioner it has been submitted that the petitioner is in custody since 16/04/2015. Charge sheet has been submitted in this case. It is further submitted that the petitioner has got no criminal antecedent. As per prosecution itself it is admitted that the informant is none but the wife of the

Patna High Court Cr.Misc. No.23418 of 2015 (3) dt.12-08-2015 2/2 petitioner, who has alleged that rape has been committed upon her by this petitioner. Further, it is submitted that the petitioner may be released after completion of six months in custody from 16.4.2015.

On behalf of the State, it has been submitted that the petitioner is named in the FIR and there is specific allegation made against him of committing rape upon the informant. Considering the facts aforesaid, let the above named petitioner may be released on bail, after completion of six months custody in jail from 16.4.2015, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Dharmendra Kumar Tiwary, Judicial Magistrate, 1st Class, Saran at Chapra, in connection with Panapur P.S.Case No. 124 of 2014.
