JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-302/34 of the Indian Penal Code.
Petitioner is languishing in jail custody since 07-102011 and earlier, his prayer for bail was twice rejected by this court but submission on behalf of petitioner is that one co-accused, namely, Ram Dayal Yadav having more or less similar allegation, has already been granted privilege of bail by this court, taking note of his long detention in custody.
Learned counsel for the petitioner files web copy of order dated 09-03-2016 passed in Cr. Misc. No. 57006 of 2015
Patna High Court Cr.Misc. No.22921 of 2016 (4) dt.17-08-2016 2/2 which goes to show that co-accused Ram Dayal Yadav was granted privilege of bail by this court as out of 17 charge sheeted witnesses, only 10 prosecution witnesses could be examined even after lapse of four years of framing of charge. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Khodawandpur P.S. Case No. 124 of 2011 corresponding to Sessions Trial No. 190 of 2012 to the satisfaction of Learned Ad hoc Additional Sessions Judge-I, Begusarai. (Hemant Kumar Srivastava, J) A.K.V./- U T
