2. The petitioner seeks bail in connection with Kajraili P.S. Case No. 72 of 2020 dated 27.10.2020, instituted for the offence punishable under Sections 302, 201 of the Indian Penal Code.
3. As per FIR, a headless body of unknown lady was recovered by Rajendra Paswan, who is the Choukidar of Circle No. 2 and informant of present case. The dead body appears 6-7 days old was almost decomposed. A suspicion is raised through F.I.R. that after committing murder somewhere else, the dead body was thrown at the place from where it was recovered, with intention to disappear the evidence regarding crime in question.
4. Learned counsel for the petitioner submits that the

It is further submitted that F.I.R. has been lodged against unknown person by the local chowkidar. Petitioner has been made accused in the case on the basis of confessional statement of co-accused, Fantus Yadav. Except confessional statement of co-accused, Fantus Yadav, there is no material available against the petitioner in the case diary. There is no eye witness to the alleged occurrence. It is further stated that co-accused namely, Shambhu Sharma @ Shambhu Kumar Sharma, who is the husband of deceased has been granted bail vide order dated 07.07.2023 passed by a Co-ordinate Bench of this court in Criminal Miscellaneous No. 30453 of 2023. Lastly, it has been submitted that the petitioner is in custody since 10.02.2025, he has no criminal antecedents and charge-sheet has been submitted in the case.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., XIV, Bhagalpur
