The petitioner is languishing in custody since 09.04.2015 in a case registered for the offences punishable under section 379 IPC subsequently 411 of the IPC was also added. On theft of Bolero vehicle, the FIR was lodged against unknown. The name of the petitioner sprang up on the confession of co-accused Mukesh Paswan, subsequently, petitioner also confessed the guilt. It is alleged that on the confession of petitioner and co-accused Mukesh Paswan the vehicle in question was recovered.

It is submitted by learned counsel for the petitioner that in the confession of co-accused Mukesh Paswan at earlier

Patna High Court Cr.Misc. No.22302 of 2015 (2) dt.07-07-2015 2/2 point of time wherein it is suggested that the vehicle in question is parked at the house of Salman, hence, the vehicle cannot be treated to be recovered on the confession of the petitioner. Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Sarai P.S. Case No.244 of 2014.
