JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-376(2)(G), 354/34 of the Indian Penal Code and Sections-4/5/6 of the POSCO Act.

Taking into consideration that the victim has supported the accusation of gang rape in her statement, recorded under Section-164 of the Cr.P.C. and, furthermore, the petitioner and his associates were caught by the police just after the occurrence, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Special (POSCO) Case No. 150 of 2015 arising out of Mehdiganj P.S. Case No. 69 of 2015 pending in the court of learned Additional District & Sessions Judge-I, Patna stands rejected.
