The petitioners apprehend their arrest in connection with Ekangar Sarai P.S. Case no. 41 of 2019, registered under Sections 341, 323, 324, 325, 307, 379, 354(a) (b), 337, 504 and 506/34 of the Indian Penal Code. The accusation is that on 06.03.2019, while sister -in-law of the informant was going to attend call of nature, Brajesh Yadav (Petitioner No.2) with bad intention caught hold her and tried to take her towards canal then sister-in-law of the informant raised alarm on which informant along with his brother Dharmendra Yadav rushed there then Brajesh Yadav
Patna High Court CR. MISC. No.33341 of 2019(2) dt.19-07-2019 2/2 assaulted to Dharmendra Yadav by means of Khanti at his head, when informant rushed to save his brother then petitioner No.2 Bidyanand Prasad assaulted him by means of iron rod on his head.
Learned counsel for the petitioners submits that at the time of occurrence, the petitioners' side also sustained injury regarding which Ekangarsarai P.S. Case No. 42 of 2019 was instituted on the basis of fardbeyan of Sidhi Prasad, father of petitioner No.2. Moreover, the injuries as found on the person of informant and his brother are simple in nature. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. Hilsa at Nalanda in connection with Ekangar Sarai P.S. Case No. 41 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
