JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-08-2019 This application, for grant of anticipatory bail, arises out of Sadar P.S. Case No. 146 of 2019, disclosing offences under Section 7 of the Essential Commodities Act. Allegation is that police raided the godown of the petitioner and found 452 bags of Arwa rice total 226 quintals and electronic weighing machine and other articles and no paper was produced and it was suspected that the said rice belongs to the Government and were carried after changing the bags for black marketing.
Submission of learned counsel for the petitioner is that there is no control order relating to rice in enforce and there is no search memo as such the question of producing the papers does not arise. He has falsely been made accused in this
Patna High Court CR. MISC. No.34503 of 2019(3) dt.21-08-2019 2/2 case and he is paying all the taxes tot the Government. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Purnea, in connection with Sadar P.S. Case No. 146 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. (Vinod Kumar Sinha, J) sunilkumar/- U T
