JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 15-04-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Chapra Muffasil P.S. Case No. 569 of 2020, registered for the offences punishable under Sections 147, 341, 323, 326, 504 and 379 of the Indian Penal Code.
As per allegation, seven accused persons named in the FIR surrounded the informant and assaulted him with fists and slaps. The allegation against the present petitioner is that he injured the left ear of the informant by teeth bite. Co-accused, Rajnath Manjhi, took Rs. 500/- from his pocket.
Learned counsel for the petitioner has submitted that the
Patna High Court CR. MISC. No.45349 of 2021(2) dt.15-04-2022 2/2 FIR reveals itself that, there is previous land dispute between the parties as it has been mentioned in the FIR that one month prior to the occurrence there was some hot discussion between the accused persons and the informant. He has further submitted that allegation is of teeth bite but the injury is simple in nature caused by hard and blunt substance which falsifies the allegation mentioned in the FIR. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks, be released on anticipatory bail before the learned court below on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, IXth, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 569 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court. (Nawneet Kumar Pandey, J) SONALI/- U T
