The petitioner apprehends his arrest in connection with Hajipur Town P.S. Case No.61 of 2021, registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The petitioner and other co-accused persons are said to have killed the daughter of the informant for non-fulfillment of demand of additional dowry.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. No specific overt act is alleged against the petitioner. It is further submitted that the petitioner is brother-inlaw of the deceased and he is living separately from the husband

It is also submitted that the petitioner has got no criminal antecedent as stated in paragraph3 of the bail application. Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Perused the case diary. From perusal of the case diary, it transpires that there is ample evidence in the case diary to show the involvement of the petitioner in the present case. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
