2. The petitioner apprehends arrest in connection with Narayanpur P.S. Case No. 19 of 2025 for the offence registered under Sections 137(2), 140(3) of Bharatiya Nyaya Sanhita.

3. Allegation against the petitioner is that he had provided a mobile phone to the victim girl to contact with coaccused Chhotu Kumar.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in this case. No incriminating article has been recovered from the conscious possession of the petitioner and the victim girl was recovered from possession of the co-accused Chhotu Kumar with whom she has love affair. The petitioner has no concern

Patna High Court CR. MISC. No.34301 of 2025(2) dt.20-06-2025 2/2 either with the victim girl or the co-accused Chhotu Kumar. The alleged mobile does not belong to the petitioner. The petitioner is aged about 72 years having no criminal antecedent and he undertakes to cooperate in the investigation and the trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Narayanpur P.S. Case No. 19 of 2025, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.
