The petitioner seeks bail in Buxar (Industrial Area) P. S. Case No. 38 of 2019 instituted for the offence under Section(s) 25(1-b)a, 25(1AA), 26, 29 and 35 of the Arms Act. Learned counsel for petitioner submits that petitioner is not named in the written report.

As per written report, one Dharmesh Yadav was apprehended by the police on the spot and one country made loaded pistol with two live cartridges have been recovered from his possession. He disclosed the name of different persons including this petitioner alleging that this petitioner has sold illegal arms with Dipu Upadhyay. Seizure list is part of the FIR. From perusal of the seizure list, it appears that three live

Petitioner is in custody since 10.3.2019 having no criminal antecedent.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the CJM Buxar in connection with Buxar (Industrial Area) P. S. Case No. 38 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
